Terms of use

  Preamble   

 

These general terms and conditions of use and sale of Pittikki.com exclusively govern the relationship between Pittikki.com.com and the user.

 

Pittikki.com allows Users to order products on the internet, for persons residing in Côte d'Ivoire (the "Beneficiaries"). After validation of the payment of the order, the user receives an email of confirmation and the Beneficiary is notified by SMS. ​

 

These general terms of use define the terms and conditions of ordering on the www.pittikki.com website. When placing an order via the site, the User acknowledges that he/she has read the general terms and conditions of sale and expressly declares that he/she accepts them without reservation. ​

 

1. Account opening and terms of use

 

The User certifies that he/she is at least 18 years old, has the legal capacity or has parental authorization to use pittikki.com. pittikki.com users can place their orders in "Guest" mode, i.e. without having to open an account or decide to open a user account.

 

By suscribing user agree to receive text messages from Pittikki.com and affiliates. Please, be advised that sms and data rates may apply. Pittikki.com doesn't sell personal information to third parties.

In ''Guest'' mode, the user just needs to enter their name, delivery and billing details to finalize the transaction. They won't have to fill in any additional fields, such as account names and passwords, and their data isn't stored in your database.

 

When creating the pittikki.com Account, the User will provide his/her surname(s), first name(s), as well as a valid email, then choose a password. The username and password are valid as proof of the identity of the User and are binding on any order placed through them.

 

The user is fully and exclusively responsible for his/her username and password. He/she will be solely responsible for the consequences that may result from any use by third parties who may have knowledge of it, unless he/she demonstrates that the knowledge of his/her username and password by another person is the result of a fault of pittikki.com.

 

In the event that they forget their password or username or if they fear that a third party may have found out about it, the user has a function on the site that allows them to retrieve their username and choose a new password.

2. Use of the Account and Ordering Products

 

The Account is strictly personal, and therefore cannot be shared or exchanged with a third party. Prices are displayed in Euros with an approximation of the equivalent in dollars, orders are paid in US dollars, legal tender in the United States.

 

In the event that the User does not reside in a country where the dollar is legal tender, the exchange rate that will be applied for this purpose will be that charged by his bank. Purchases are made by Users using a credit card.

 

For each order, the User indicates the identity (name and surname) and the mobile phone number of the beneficiary. The user receives a confirmation of the purchase made by email and Pittikki.com.com informs the recipient by SMS.

 

In the event of delays, losses, errors or omissions resulting from a telecommunications disruption, Pittikki.com.com cannot be held responsible for the non-delivery of the SMS informing the beneficiary designated by the user of the purchase made for his benefit.

 

3. Exclusion from the Service

 

Pittikki.com.com may automatically and immediately suspend the use of the Service by the User or the Beneficiary in the event of suspicion of fraud, attempted fraud or proven fraud by these persons. Pittikki.com may automatically and immediately suspend the use of the Service by the User for failing to comply with any of its obligations.

 

4. Personal Data and Control

 

The User must at all times ensure that the information provided by him is accurate and up-to-date. All boxes marked as mandatory in the registration procedure on the Site must contain valid information.

 

Any attempt at fraud through the presentation of inaccurate information about the User or the Beneficiary will be communicated to the competent authorities and may lead to the immediate denial of access to the Site and the Service.

 

Each User has the right to access the data concerning him or her collected and processed by Pittikki.com.com as well as the right to modify and delete the data concerning him/her.

 

It authorises Pittikki.com and its partners to transmit information to the regulatory authorities as required by law. The User's contact details will not be disclosed to third parties, unless expressly agreed by the User. All information in connection with any order on Pittikki.com.com is subject to data processing.

 

The purpose of this processing is to combat fraud of all kinds. Credit or bank card payment service providers and Pittikki.com are the recipients of the data in connection with all orders. Any unpaid order or suspicion of payment fraud for any reason, automatically cancels the order.

 

5. Payment methods

 

Payment is made by debit or credit card. Pittikki.com.com reserves the right not to respond to the order of a User for whom problems have already occurred.

 

6. Prices

 

The prices shown on the product listings and product sheets do not include delivery costs. The total price indicated in the confirmation of receipt of the order includes the price of the products and the delivery costs. ​

 

7. Delivery

 

Delivery times are 72 hours depending on the recipient's availability. At the time of ordering, the User shall provide the name and mobile phone number of the beneficiary of the order in Côte d'Ivoire. This phone number will be used to verify the identity of the Beneficiary upon delivery.

The user has also the ability to add a six digits secret code for the identification of his beneficiary. If he does, it is his responsibility to provide the code to his beneficiary, Order will not be delivered unless the beneficiary disclose the secret code provided.

 

To receive the order, the beneficiary must present the delivery person with an identification document (national identity card or other) and sign a delivery note. Once the order has been validated, Pittikki.com contact the Beneficiary to schedule the delivery. If the mobile phone number provided to reach the Beneficiary is not valid,

 

Pittikki.com immediately informs the user by email, who then chooses either to cancel the order or to provide another mobile phone number; To do so, he has a period of 24 hours from the email received by Pittikki.com and the delivery person will then try once again to contact the Beneficiary to organize the delivery.

 

At the time of delivery, the Beneficiary of the order must present his/her identity document (national identity card) and sign a delivery note. Possible delays in delivery do not entitle the User to cancel the order, refuse the products or claim damages.

 

8. Liability of Pittikki.com.com

 

Pittikki.com.com can only be held liable for proven facts that are exclusively and directly attributable to him. Only direct and certain damages suffered by the User may be compensated. Pittikki.com.com acting as an intermediary cannot be held liable for damages of any kind, whether material, immaterial or bodily injury, that may result from theft or misuse of the Site.

 

The responsibility of Pittikki.com.com cannot be held liable for any risk inherent in the use of the Internet, such as suspension of the service, intrusion, the presence of computer viruses or fraudulent purchases by a third party.

 

Pittikki.com.com cannot be held liable for errors made by the User or the Beneficiary in the context of the use of the Service. Pittikki.com puts in place the necessary means for the smooth running of the Service. As such, Pittikki.com will not be held liable in the event of force majeure.

 

9. Liability of the User and the Beneficiary

 

The Beneficiary must ensure the safekeeping of his/her mobile phone As long as no objection has been lodged with Pittikki.com.com due to the loss or theft of the Beneficiary's mobile phone, the User and the Beneficiary shall bear the consequences of all deliveries made. The Service must be used in compliance with these terms and conditions of use, the legislation in force and in accordance with the use for which it is intended. Pittikki.com disclaims any liability for any use of the Service that does not comply with these terms.

 

10. Formation of the Contract and Proof of Transaction ​

 

The orders are summarized before the User is asked to validate them. The User is then asked to "confirm the payment"; The validation of an order by a click constitutes a firm and definitive validation subject to the reservation referred to in the following paragraph. Any order with a choice of payment by credit card is only considered effective when the payment centres concerned have given their consent. In case of refusal by the said centres, the order is automatically cancelled and the User is notified by a message on the screen. The computerized data, securely stored in the computer systems Pittikki.com will be considered as proof of communications, orders and payments between the parties. They are kept within the legal time limits for commercial sale and can be produced as evidence. ​

 

11. Confirmation, preparation and formation of the contract

 

Pittikki.com confirms to the User the receipt of his/her order by an e-mail summarizing the products ordered, the chosen means of payment, the cost of delivery, and the total invoice of the service. Pittikki.com reserves the right not to accept an order, for a legitimate reason, relating for example to a difficulty in the supply of a product, a foreseeable problem concerning the delivery to be made (e.g. delivery requested in a geographical area where there is a proven risk of aggression) or relating to the abnormality of the order placed on the site Pittikki.com In the event that an order cannot be accepted for one of the above reasons, Pittikki.com.com will inform the User. The risk is transferred to the User at the time of provision or delivery. The information provided by the user, when placing the order, is binding on the user: in the event of an error by the User in the wording of his contact details or those of the place of delivery, in particular his surname, first name, address, telephone number, email address or bank or payment card number, resulting in the loss of the products,  The User remains responsible for the payment of lost products.

 

12. Financial Terms and Service Fees

 

The applicable rates per Pittikki.com are available on the Site. These rates can be changed unilaterally by pittikki.com at anytime and without notice.

 

13. Products, Availability and Warranty ​

 

Pittikki.com makes available to the user all the essential characteristics of the products present in the catalogues published by pittikki.com before the order is placed, depending on the availability of stocks. The legal warranty of the available products is provided by the supplier and the manufacturer. Photographs that may accompany this description have no contractual value. The products offered by Pittikki.com are intended to be made available or delivered in Côte d'Ivoire.

 

The order is executed no later than 3 days from the day following the day on which the user placed the order. However, in the event of unavailability of the product ordered, in particular due to our partner supermarkets, the User will be informed as soon as possible. In such a case, pittikki.com undertakes to offer the buyer a similar product at a similar price. The beneficiary benefits from the legal guarantee of conformity and hidden defects on the products sold.

 

14. Dispute Provisions ​  

 

In the event of a dispute or claim, the User shall first contact Pittikki.com.com for direct conciliation between the parties. If a solution is not found one month after the claim is made, jurisdiction shall be assigned to the courts of the State of Pennsylvania to the States. ​

 

15. Intellectual Property ​

 

The Site, the applications and all the elements appearing therein (information, data, sounds, images, drawings, graphics, distinctive signs, logos and trademarks) are the exclusive property of Pittikki.com All of these elements are protected by intellectual property rights and as such, are protected against any use not authorized by law. ​ In particular, it is strictly forbidden to use or reproduce the name Pittikki.com.com and/or its logo, alone or in combination, for any purpose whatsoever, and in particular for advertising purposes, without the prior written consent of Pittikki.com The User is also prohibited from compiling or disassembling the Site, the applications, using them for commercial purposes or infringing in any way whatsoever the copyright and intellectual property rights of Pittikki.com ​

 

16. General Terms and Conditions

 

These terms and conditions come into force as soon as they are posted online. They govern all orders placed until they are collected. In particular, it is strictly forbidden to use or reproduce the name Pittikki.com and/or its logo, alone or in combination, for any purpose whatsoever, and in particular for advertising purposes, without the prior written consent of Pittikki.com. Pittikki.com reserves the right to modify the Site, the service provided and the general terms and conditions of use and invites the User to carefully re-read the general terms and conditions of sale in force with each new order. ​
